TERMS AND CONDITIONS 1 Introductory provisions 1.1 These Terms and Conditions (the "Terms") apply to online bookings of accommodation services provided by the Pension Operator, usage of the online reservation system of the Pension Operator, payment and cancellation conditions for online bookings made by customer/customers via the website as well as all the other rights and obligations arising from the legal relations created from the online booking. 1.2 The Client is entitled to use the online reservation system only in case of agreement with the Terms. The Client is advised in his own interest to familiarize with the Terms before making a reservation. At repeated use of online booking, the Client is always obliged to familiarize with the up to date Terms. The Pension Operator reserves the right to unilaterally change the Terms, while the change of the Terms is effective from the date of its publication on the Pension Operator´s website. If the Client does not agree with any provision of the Terms, he is requested by the Pension Operator not to use the online reservation system. By the confirmation of a reservation the Client expresses the unconditional agreement with theTerms. 1.3 Each Client takes into consideration that all prices and conditions of booking and provision of services apply exclusively to online bookings made through the website. 1.4 By using the online reservation system the Client declares that he has reached the age of minimum 18 years and has the legal capacity to acquire rights and assume obligations in his own name. 2 Reservation 2.1 By online reservation the Client has a possibility to look up for the current free accommodation capacity of the pension in accordance with requirements specified in the reservation form (arrival date, departure date, room type, etc. 2.2 By online reservation after selecting all the data for specifying the beginning and the end of stay, room type, additional services, etc., the Client completes all the required data. 2.3 After completing all the required data, making an advance payment under the Terms and reviewing the data, the Client will immediately receive a confirmation of booking with reservation number to by him provided email address. Assigned reservation number serves as a booking confirmation, a contact data for the implementation of any changes or cancellation of a booking and also as a confirmation information on arrival. For this reason the Client is obliged to deposit a reservation number safely. 3 Payment conditions 3.1 The Pension Operator is entitled to receive payment for services before a provision of these services and the Client is obliged to pay before services are provided. The Pension Operator is entitled to demand a reimbursement of an advance payment when booking online in an amount of minimum 50% of the price for a stay and the Client is obliged to pay a surcharge to the total price at arrival. 3.2 The Client is obliged to pay a full amount of the advance payment for a stay reserved during online booking via credit card (Card Pay), Tatrapay service or bank transfer. For this reason, while booking online via Card Pay a credit/debit card number is required from the Client. By confirming a booking the Client declares an agreement for processing an advance payment for the booked stay in a full amount for the benefit of the Pension Operator (by downloading an advance payment for a stay) and entitles the Pension Operator to the payment settlement. The payment settlement of a booked stay is immediately debited on the bank account of the Pension Operator. 3.3 The policy and actions of the Pension Operator are based on ethical principles and respect privacy of the Client. The reservation system uses the latest systems of the sensitive data coding that guarantee a full safety of the data provided by the Client during payment processing. 3.4 The Client authorizes the Pension Operator to verify the credit/debit card information provided in the corresponding call-centre of a bank or a company which issued a credit / debit card. 4 Reservation changes and cancellation conditions 4.1 Any changes of a finalized reservation are possible to make from the Client´s side either electronically by entering the email address of the Client specified by him during online booking and also the reservation number allocated and sent to the Client while booking online, or in writing, by telephone or e-mail through the reservation department of the Pension Operator, using following contact information: telephone number: +421 910 393 939, e-mail address: [email protected], postal address: Pension SKI Jezersko, 059 04 Jezersko 56. While requesting any change of online booking, the Client is always obliged to state a reservation number assigned when making online booking and sent to the Client´s e-mail specified during online booking. If the Client requests a change of online reservation which cannot be met due to capacity or operational reasons and the Pension Operator will take all possible steps to meet the requirements of the Client, the Pension Operator is not obliged to meet requirements of the Client for a change of a made online reservation. In this case the Client is not entitled to neither a compensation of damages nor any other compensation from the Pension Operator due to inability to change a confirmed online reservation. 4.2 In case of the Client´s withdrawal from the contract and a cancellation of the reservation, the Pension Operator is entitled to a cancellation fee as follows: A cancellation fee valid for all stays except of TOP season: 50% from the price of accommodation of the stay 20 days before the date of arrival A cancellation fee valid for all stays in TOP season: 50% from the price of accommodation of the stay 30 days before the date of arrival 80% from the price of accommodation of the stay 29 to 20 days before the date of arrival 100% from the price of accommodation of the stay 19 days or less before the date of arrival 4.3 In case the Client does not show up for a booked stay, the Pension Operator is entitled to a cancellation fee of full advance payment. 4.4 In case of Client´s withdrawal from the contract and the cancelation of the reservation or in case of partial Client´s withdrawal from the contract and partial cancellation of the reservation or no-show of the Client on a booked stay in exceptional circumstances (illness, death, natural disaster, etc.) the Pension Operator is authorized not to charge a cancelation fee under the condition of being presented a credible evidence of a serious cause of Client´s withdrawal from the contract and the cancelation of a reservation or partial Client´s withdrawal from the contract and partial cancellation of a reservation or from the expected arrival day in case of Client´s no-show on a booked stay. 4.6 In the event of Client´s withdrawal from the contracts and cancellation of the reservation or partial withdrawal from the contract and partial cancellation or Client´s no-show, the Pension Operator will send a notice of a claim of a cancelation fee and its amount either in writing or by e-mail to the Client under the Terms within 14 days from the date of Client´s withdrawal from the contract and cancelation of the reservation or from the date of partial Client´s withdrawal from the contract and partial cancelation of the reservation from the expected arrival date of a booked stay in case of Client´s no show. By confirmation of the booking and expressing an agreement with the Terms, the Client agrees and acknowledges that the Pension Operator is entitled in case of Client´s withdrawal from the contract and cancelation the reservation or partial withdrawal from the contract and the partial cancellation, or Client´s no-show on a booked stay unilaterally count Client´s claim to a refund of the price of the stay when making online reservations by the Client contra the claim of the Pension Operator to a cancelation fee in amount stated in the Terms above, in the amount of a coverage of both claims considering that the exceeding sum of mutual claims of the Client and the Pension Operator in favour of the Client will be transfered by the Pension Operator to the Client via bank transfer to the bank account of the Client from which client made a payment for a stay when booking online within 30 working days from a day that follows a day of Client´s withdrawal from the contract and cancelation of the reservation or partial Client´s withdrawal from the contract and partial cancelation of the reservation or Client´s no show on a booked stay. A bank charge of a refund of the price of the stay bears the Client. 5 Specific provisions 5.1 In case of questions or issues that arise from the online reservations, the Client is entitled to contact the reservation department of the Pension operator by telephone on the following number: +421 910 393 939 or by email: [email protected]. 5.2 Check-in is possible on the first day of the stay within the meaning of the reservation from 02.00 o´clock p.m. Check-out is on the last day of the stay within the meaning of the reservation until 10.00 o´clock a.m. 5.3 In the case of any special requirements (a baby cot, late arrival or departure ( late check-in or late check-out ) or in case of an interest to book additional services, the Client is entitled to contact the reservation department of the Pension Operator by telephone on the number: +421 910 393 939 or by email: [email protected]. 5.4 The Pension Operator is entitled to a discount on the stay for children under 12 years old as follows: 5.4.1 For children under 3 years old (0 - 2 years included) 100% discount without entitlement to bed or extra bed 5.4.2 Children under 12 years old (3 - 11 years included) 40% discount The Pension Operator reserves the right to change the age category and the amount of provided discounts. 6 Special offers 6.1 The Pension Operator is authorized to special offers (last minute, first minute, etc.). Number of rooms allocated for special offers is limited. 6.2 For reservation and implementation of special offers The Specific Terms and Conditions are valid which are applicable only for special stays that take precedence over The Terms. The Terms will be used in case of special stays only in those parts that are not modified in The Specific Terms and Conditions otherwise or separately. 7 Personal data and privacy protection 7.1 The company CONZULTING AZ Ltd. operator, Riečna No.2, 811 05 Bratislava, Organisation identification No.: 36 283 550 registered in the Commercial Register at Prešov maintained by District Court, section Ltd., file no. Ltd. (hereinafter only CONZULTING AZ Ltd.), carries processing of personal data in accordance with generally binding legal regulations of the Slovak Republic, in particular in accordance with the Act No. 122/2013 of Codex on the protection of personal data and on change and completion of certain acts as accepted text of the of Act No. 84/2014 of Codex in the current and amended version (hereinafter the "Act") 7.2 The Company CONZULTING AZ Ltd. operator processes the personal data of clients for the purpose of reservations, sales, using of services by clients in the pension and a control over their use. Personal data are processed for the period necessary to fulfil the purpose of processing - reservations, sales, using services by clients in the pension and a control over their use yet for a maximum of two years from the date collection. Personal data processed for the purpose of making reservations, sales, using of services in the pension and control over their use are processed by the company CONZULTING AZ Ltd. acting on § 10, subsection 3, letter b) of the Act without the consensus of the persons concerned. 7.3 The CONZULTING AZ Ltd company operator processes the personal data of client for marketing purposes, in case of express consent of the Client that can be granted by completing the data when booking online and clicking on the consent for the processing of personal data. 7.4 Personal data processed for the purpose of marketing include: name and surname, e-mail address, mobile phone number. The CONZULTING AZ Ltd. company operator commits that personal data will not be handled and treated in contradiction with obligatory legal regulations. The consent with the processing of personal data shall be granted for a period of three years and this agreement the Client may at any time abrogate in writing by sending the abrogation of consent on the address of the Operator, except of cases when the law does not stipulate otherwise. The Client by granting the approval also confirms that he was informed of his rights stated in the law ( especially § 28 of the Act ), as well as in the Act No. 40/1964 Coll. Civil Code, in an expression of posterior rules, in particular information on the status of the personal data processing in the information system, for a repair of inaccurate or outdated personal data, on a liquidation of personal data if the purpose of the processing and disposal of personal data was fulfilled, if the law was violated, and that provided personal data are consistent with the reality, and that they are complete, true and accurate and at the same time is giving consent for a period of 3 years for sending commercial and advertising materials ( so called newsletters) by any electronic form of messages (via e-mail, SMS) concerning services provided by the operator and his business partners, while the Client is privileged to call out the granted consent at any time by written notification sent to the contact address of the Operator or to the email address specified directly in the newsletter. 7.6 The CONZULTING AZ Ltd. company operator uses the high ethical standards and respects the privacy of Clients. With the exception of providing the information required by law or by other generally binding regulations, the operator neither provides or makes accessible any personal information to third parties or other beneficiaries without the Client's consent. The booking system uses in the present the latest systems of sensitive data coding. 7.7 The CONZULTING AZ Ltd. company operator in accordance with the legislation of the Slovak Republic shall take all measures and operations on the processing of personal data so that the persons concerned were properly and timely informed of their rights granted to them by legislation of Slovak Republic but also based on European legislation and binding international contracts and conventions. In case of receiving an authorized application of person concerned, the company operator clears the application within 30 days of receipt. 7.8 The person concerned has the right in particular upon written request addressed to the company operator demand information about whether the personal data are or are not processed in the information system of the company operator, from what source were the personal data collected, the information on the extent or the list of personal data processed, the correction or liquidation of its incomplete, inaccurate or outdated personal data, liquidation of personal data whose purpose of processing already passed or which are subject to illegal processing. 7.9 The person concerned has the right to argue against the processing of personal data for purposes other than those on which personal data have been validly supplied and against the processing of the personal data that could illegally and reasonably interfere with his rights and interests protected by law, if the objection is justified. The company operator is obliged to block such personal data without pointless delay and to liquidate them as soon as circumstances permit. 7.10 The person concerned has the right in case of suspicion of unauthorized processing of personal data submit a proposal to the Office for Personal Data Protection of the Slovak Republic for initiating procedures on the protection of personal data. 7.11 The person concerned who does not have the legal capacity of legal acts in the full extent implement his rights through a lawyer. 7.12 The rights of the person concerned, who is no longer alive, may be enforced by a close contact under the specific legislations of Slovak republic. 8 Final provisions 8.1 The Terms and the legal relations arose upon their authority shall be governed by the law of Slovak Republic. 8.2 Should any provision of the Terms be or become invalid, ineffective or unenforceable, such invalidity, ineffectiveness or unenforceability shall not affect the validity and effectiveness of the remaining provisions of the Terms. 8.3 The Client when confirming the reservation online expresses his agreement with the Terms and commits to follow them. The pension operator reserves the right to change the Terms. The obligation of written notice about any change of the Terms is met by publishing the amended Terms on the web the Pension Operator´s website www.penzionskijezersko.com. 8.4 The Terms are valid and effective from 4 January 2016. 1. Terms
1.1. The Hotel.cz website (" Hotel.cz Portal ") is a portal for arranging accommodation reservations operated by HOTEL. CZ as , with its registered office at Kolbenova 882 / 5a, Vysočany, 190 00, Prague 9, registered in the Commercial Register at the Municipal Court in Prague, Section B, Insert 9533 (" Operator "). 1.2. Accommodation facility is the owner / tenant of accommodation facilities (" Accommodation facility "), providing the Customer with services according to the order mediated on the Hotel.cz Portal .
1.3. Customer is a person (natural or legal) ordering services offered in Accommodation Facilities (" Customer ").
2. Introductory provisions
2.1. These General Terms and Conditions (" GTC ") govern the contractual relationship between the Operator, the Customer and the Accommodation Facility in the implementation of accommodation booking offered by the Accommodation equipment on the Hotel.cz Portal (" Service ").
2.2. The contractual relationship between the Operator and the Accommodation Facility is governed by the brokerage agreement and these GTC.
2.3. The contractual relationship between the Operator and the Customer is governed by the Contract (as this term is defined below), these GTC and the business conditions of each individual Accommodation Facility („ OP facilities “), which are listed in the footer of the reservation form for each specific Accommodation Facility mediated on the Hotel.cz Portal. In the event of a conflict between these GTC and the OP facility, the business conditions that are more favorable for the Customer shall prevail. The customer is obliged to get acquainted with the GTC and OP equipment.
3. Applicable law and legal regime
3.1. Contractual relations between the contracting parties are governed by the laws of the Czech Republic.
3.2. The Czech Trade Inspection Authority, with its registered office at Štěpánská 567/15, 120 00 Prague 2, Company Identification Number: 000 20 869, Internet address, is responsible for out-of-court settlement of consumer disputes under the Agreement. : http://www.coi.cz/. The online dispute resolution platform at http://ec.europa.eu/consumers/odr can be used to resolve disputes between the Operator and the Consumer Customer under the Contract by electronic means.
3.3. European Consumer Center Czech Republic, with its registered office at Štěpánská 567/15, 120 00 Prague 2, internet address: http://www.evropskyspotrebitel.cz/ is a contact Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution and amending Regulation (EC) No 2006/2004 and Directive 2009/22 / EC consumer dispute resolution online).
4. The process of ordering and paying for services
4.1. Ordering
Customer expresses its interest in the Service by submitting a booking form (" Order "). The Operator verifies the free capacity at the Accommodation Facility within the term required by the Customer in the Order and informs the Customer about the availability and specific price of accommodation for the selected date. Binding ordering of the Service occurs at the moment of telephone or written confirmation of the Order / approval of the binding offer by the Customer and the Operator (sending the accommodation voucher to the Customer).
The operator on the Hotel.cz Portal also displays the offers of Accommodation Facilities advertised on the web portal www.spa.cz („ Spa Portal .cz “). In the event that an Order for a stay is sent from the Spa.cz Portal, the given contractual relationship is governed by the business conditions of the Spa.cz Portal, available at: https://www.spa.cz/vseobecne-obchodni-podminky.html. The Customer is obliged to read the given business conditions before sending the Order.
4.2. Price of the service
The price of the Service is determined by the Accommodation Facility. The price depends on the selected date, number of persons and other parameters entered by the Customer in the Order. Prior to the binding confirmation, the Operator informs the Customer about the final price (with information about the currency in which the price is governed); after the approval of the binding offer by the Customer, a binding order for the Services will take place, ie a contract will be concluded between the Customer and the Operator ("Contract").
The prices displayed for individual Accommodation Facilities on the Hotel.cz Portal are determined by the Accommodation Facilities, are only indicative and are not binding until the binding offer is sent by the Operator to the Customer.
The Hotel.cz portal publishes offers of Accommodation Facilities in addition to Czech crowns also in selected foreign currencies (especially in EUR), while conversion into Czech crowns is governed by the exchange rate set by the accommodation beginning or the current exchange rate of the Czech National Bank listed on https://www.cnb.cz/cs/financni-trhy/devizovy-trh/kurzy-devizoveho-trhu/kurzy-devizoveho-trhu/ - the conversion is always valid at the time of the Customer's visit to the Hotel.cz Portal. The Customer acknowledges that when publishing offers of Accommodation Facilities in a currency other than Czech crowns, the amount expressing the price for the Services may be adjusted after the execution of the Order (especially due to a change in the exchange rate). However, the final price expressed in the currency binding for the given Order does not change from the moment the binding offer is sent by the Operator.
Unless otherwise stated, the final price does not take into account any additional requirements of the Customer that were entered in the note field during the Order or such requirements that are considered additional during the telephone order, of which the Customer is informed during the call. Additional notes are also displayed in the accommodation voucher and accompanying e-mails. Additional requirements are actively negotiated by the Accommodation Facility directly with the Customer.
In the case of non-refundable reservations, the Accommodation Facility is entitled to deduct the corresponding amount only if such additional requirements of the Customer affect the total price of accommodation. The operator is not responsible for providing additional requirements, their price or quality.
4.3. Payment Terms
Payment is made at the Accommodation Facility. For some bookings, especially for group bookings, a credit card guarantee or a deposit of up to 100% of the stay may be required. The Customer is informed of the credit card guarantee or prepayment during the Order Confirmation process.
In special cases, but especially in case of repeated arrivals or complaints of accommodation providers for violation of the accommodation regulations, the Customer may be required to guarantee a payment card.
4.4. Gift vouchers
Gift vouchers are vouchers issued by the Operator, which the Customer can purchase and use to pay for the Order with them, ie a stay in the Accommodation Facility ("DP") can be purchased with them. The values on the DP with the values of other discount coupons cannot be added at the same time.
The customer has the opportunity to purchase a DP in one of the offered values, which can then be used for one of the stays offered on the Hotel.cz Portal. The information about the specific stay stated on the DP is not binding and the DP can also be used for other stays offered at the time of applying the DP on the Hotel.cz Portal.
The customer has the option to choose the form of DP delivery. The electronic form of DP delivered to the Customer's e-mail address is free of charge, the paper form of DP delivered via a postal service provider (eg Czech Post) is charged CZK 70.
DP is non-transferable after its issuance and can be used only by the Customer or the person listed on it, to select a stay package from the current offer on the Hotel.cz Portal and other sites specified by the Operator (currently only on the Spa Portal. cz) with regard to the free capacities of the Accommodation Facility.
The validity of the DP is indicated on its front page and is at least 12 (in words: twelve) months from the date of its issuance. If the validity of the DP according to these GTC differs (is shorter) from the one stated on the front of the DP, the validity on the front of the DP takes precedence . After the expiration of the DP (eg in case of non-use), the Customer loses the opportunity to apply it and is not entitled to claim compensation for it.
The Operator may decide to extend the validity of the DP at the request of the Customer. The Customer is not entitled to such an extension and is aware that it always depends on the decision of the Operator.
Each DP, or any discount or other coupon provided by the Operator in connection with its Services, is a one-time and expires after its application.
If the value of DP does not reach the price of the booked stay, the difference can be paid by any payment method allowed by the Operator. If the price of the stay is lower than the value of the DP, the difference in value will not be reimbursed and no financial compensation can be claimed for it.
DP is not exchangeable for money, it cannot be exchanged or drawn gradually. The value of DP can be exhausted only by its one-time application.
4.5. Communication mediation
By acceding to these GTC, the Accommodation Facility agrees to mediate communication by the Operator through the Hotel.cz Portal (including any processing, storage, receipt, access to, viewing and monitoring of communication by the Hotel.cz Portal) („ Communication mediation b) “) and declares that it thoroughly informs its employees, representatives and other persons (and in accordance with the applicable legal regulations it will inform them and possibly obtain consent) about the use of the Communication Mediation service provided to it or is provided on its behalf. The accommodation facility agrees not to use the Communication Mediation service to send unsolicited commercial messages. The Accommodation Facility shall fully indemnify the Operator for any third party claims or sanctions resulting from the illegal or unauthorized use of the Communication Mediation Service for the Accommodation Facility's own purposes.
5. Cancellation policy and complaints
5.1. Cancellation policy for accommodation
Cancellation conditions are specified in the OP device. In the event that the Accommodation Facility does not have its own cancellation policy defined, the first night will be charged to the guarantee by credit card guarantee in case of no-show. If the reservation is canceled by the Customer (cancellation is confirmed by the Operator to the Customer in writing) 24 or more hours before the originally planned arrival of the guest, no cancellation fee is applied to the guarantee by credit card.
5.2. Cancellation policy for gift vouchers
The customer is entitled to withdraw from the purchase contract for the purchase of DP within 14 days from the date of receipt, ie the issuance of DP, this does not apply if DP has already applied within this period.
After the issuance and expiration of the 14-day return period, DP is non-refundable and no financial compensation can be claimed for it.
5.3. The Customer is obliged to inform the Operator of any changes in the Order or its cancellation in writing.
5.4. In the event of cancellation of the Order by the Operator or the Accommodation Facility, the Operator will offer the Customer an alternative date or stay in another Accommodation Facility. In the event that the Customer does not accept the alternatives, the Operator will return to the Customer the paid payment paid by the Customer to the Operator for such canceled Order. The Customer must claim the Customer's payments made to the Accommodation Facility back after the Accommodation Facility and not after the Operator.
5.5. Complaints about the quality of accommodation and services provided by the Accommodation Facility are resolved by the Customer himself and directly with the Accommodation Facility, or with the help of the Operator, who can communicate with the specific Accommodation Facility regarding the Customer's complaint.
5.6. Complaints about the Operator's Services are possible in writing electronically at the e-mail address [email protected] or by correspondence at the address ONLINE HOLDING s.r.o., Řeznická 7, 460 01 Liberec. The Customer's complaint concerning the Operator's Services will be settled immediately, or as soon as possible after its receipt, but no later than within 30 days, and the Operator will make every effort to ensure that the Customer's complaint is resolved to his satisfaction. The customer will be continuously informed about the status and manner of handling his complaint.
6. Responsibility for content and information on the Hotel.cz Portal
6.1. All content and information stated in the offers of Accommodation Facilities are stored on the Hotel.cz Portal by Accommodation Facilities. In relation to the content and information provided in the offers of Accommodation Facilities, Hotel.cz Portal acts as a service provider, which consists in storing information provided by users (Accommodation Facilities) within the meaning of Article 14 of Directive 2000/31 / EC of the European Parliament and of the Council of 8 June 2000 on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market (the “Electronic Commerce Directive”) and Section 5 of Act No. 480/2004 Coll., on Certain Information Society Services, as amended (“ Act on certain information society services ").
6.2. The operator is not (in accordance with Article 15 of the Electronic Commerce Directive and § 6 of the Act on Certain Information Society Services) obliged to supervise the content of the information transmitted or stored by it, nor to actively seek out facts and circumstances that point to illegal information.
6.3. In accordance with Article 6.2 of these GTC, the Operator does not verify the content and information in the offers of Accommodation Facilities and does not exercise any control or supervision over them. The Operator thus does not guarantee the accuracy, completeness, correctness, legality or availability of the content and information stated in the offers of the Accommodation Facilities.
6.4. of the Act on Certain Information Society Services without delay all steps that may be required of it to remove or make such content and information inaccessible.
6.5. Any responsibility of the Operator for the content and information stated in the offers of Accommodation Facilities is governed by the rules set out in the Directive on Electronic Commerce and in the Act on Certain Information Society Services.
6.6. The Operator is responsible for its own content and information provided on the Hotel.cz Portal in accordance with the applicable legislation.
7. Notification of illegal content and information on the Hotel.cz portal
7.1. Any person may report illegal content and information on the Hotel.cz Portal to the Hotel.cz Portal in the manner described in this Article 7 of the GTC ("Notifier").
7.2. The Notifier is obliged to report illegal content to the Operator on the Hotel.cz Portal in accordance with this Article 7 of the GTC (" Notification ").
7.3. The Notifier is obliged to deliver the Notification to the Operator in writing electronically to the e-mail address [email protected] or by correspondence to the address HOTEL.CZ as, Řeznická 7, 460 01 Liberec
7.4. The notification must contain at least:
(a) details of the Notifier, including his contact details;
(b) identification of the Accommodation Facility's offer or placement of content on the Hotel.cz Portal, including the entire unique URL of the site;
(c) a statement stating that the content is illegal;
(d) an explanation of the reasons for the illegality of the content;
(e) additional information necessary to assess the illegality of the content.
7.5. The Notifier is responsible for the accuracy, veracity, completeness, legitimacy and justification of the Notification. The Notifier is responsible for the Notification, which incorrectly, falsely, unjustifiably or unjustifiably marks legally harmless content, including liability for damage caused to the Accommodation Facility to which the Notification relates and / or the Operator.
7.6. In the event that the Notification does not contain at least the data and information specified in Article 7.4 of these GBTC, such Notification may not be considered by the Operator due to the circumstances of the case. made. In such a case, the Operator is entitled to request additional information from the Notifier to the Notification.
8. Other obligations of the Accommodation Facility
8.1. The accommodation facility is responsible for the content of the offers; may not contain false or otherwise misleading information in the tenders, or information that otherwise violates the laws or rights of third parties and is liable for damages caused by a breach of this obligation.
8.2. If the Accommodation Facility repeatedly (incorrectly or repeatedly) provides false or otherwise misleading information in the offer, or information otherwise violating legal regulations or the rights of third parties, the Operator is entitled to terminate the contractual relationship with the Accommodation Facility by withdrawing from the contract. The accommodation facility is obliged to remove all its offers and content from the Hotel.cz Portal immediately after the withdrawal takes effect. If he fails to do so, the Operator is entitled to remove all offers and content of the given Accommodation Facility.
9. Personal information
The processing of personal data in the provision of the Services by the Operator (including handling cookies, sending business messages and recording telephone calls) is governed by the principles of personal data processing available here:

10. Validity and effectiveness
10.1. The Operator may continuously change or supplement the wording of these GTC. The Customer acknowledges that the GTC valid at the time of concluding the Contract will always apply to the contractual relationship between him and the Operator.
10.2. These GTC come into force and effect on 14.3.2022 .
10.3. The valid wording of these GTC is available at the headquarters of the Hotel.cz Portal and is published on the website www.hotel.cz.
